Prenuptial Agreements
A prenuptial agreement is a contract signed before marriage that spells out how assets and debts will be handled if the marriage ends. It can cover property owned before the marriage, existing debts, business interests, retirement accounts, inheritances, and assets set aside for children from a previous relationship. Child support and parenting time can’t be locked in through a prenup, as those get decided later, based on circumstances at the time.
Both parties must fully and fairly disclose their finances before signing. Skip that step, and the agreement can be challenged in court down the road. Signing a prenup isn’t a bet against the marriage, it’s a way to settle the terms up front so they’re not up for a fight later. Angela can draft, review, or negotiate an agreement built around what matters most to you.
Postnuptial agreement lawyer for fair division of money & property.
Postnuptial Agreements
A postnuptial agreement does the same job as a prenup, just after the wedding instead of before it. Couples usually come to Angela for one after something changes mid-marriage: an inheritance comes in, a business gets started, a major asset gets purchased, or they simply want clearer financial ground rules going forward.
Because life keeps moving, a postnup isn’t necessarily a one-time document. Angela can help you revisit and update it as your circumstances shift, so it keeps matching what you actually need it to do.
Prenuptial & Postnuptial Agreement FAQs
What is a prenuptial agreement?
A prenuptial agreement is a legal contract signed before marriage that explains how certain assets, debts, and financial matters will be handled if the marriage ends.
Can you do a prenuptial agreement after marriage?
No. Once you’re married, the appropriate legal document is a postnuptial agreement.
Do prenuptial agreements expire?
Not usually. Most remain in effect unless the agreement includes specific expiration terms or a court later determines that it’s unenforceable.
What is a postnuptial agreement?
A postnuptial agreement is a contract signed after marriage that establishes how certain financial matters, assets, or debts will be handled moving forward or if the marriage ends.
How long after marriage can you get a postnuptial agreement?
There is no required waiting period. A postnuptial agreement can be created at any point during the marriage, provided both parties agree and proper legal requirements are met.
Do both parties need a lawyer for a postnuptial agreement?
Each spouse is not legally required to have separate counsel, but independent legal advice is often recommended to help ensure both parties fully understand the agreement.
Angela’s Cost & Timeline
Angela bills in 6-minute increments, so you only pay for the time spent working on your matter. During your consultation, she’ll explain the retainer, discuss your specific circumstances, and give you a better idea of the expected timeline and overall process. Simpler agreements can often be completed more quickly, while agreements involving significant assets, businesses, or extensive revisions may take longer.
Separation Agreements
A separation agreement establishes the terms of an active divorce or legal separation. It can resolve property division, parenting time, decision-making responsibilities, maintenance, child support, and other financial matters.
These agreements often determine what happens to your house, retirement accounts, bank accounts, vehicles, investments, and other assets. If retirement accounts are being divided, additional documents such as Qualified Domestic Relations Orders (QDROs) may also be required.
When Angela represents you in a divorce or legal separation, she advocates for your interests while working toward an agreement that protects your future. Angela describes reaching an amicable agreement as work that takes real creativity, understanding who you’re dealing with and figuring out what they actually want and need.
Mediation Agreements
Mediation allows both parties to resolve family law issues with the help of a neutral third party. Unlike litigation, Angela does not represent either spouse and does not give legal advice to either party. If you reach an agreement, Angela puts the terms in writing in a Memorandum of Understanding. From there, that agreement still needs to become a court order, either through self-help resources or with your own attorney’s help.
If an agreement is reached, Angela prepares a Memorandum of Understanding summarizing the terms.
Separation & Mediation Agreement FAQs
What is included in a separation agreement?
A separation agreement addresses property division, parenting time, decision-making responsibilities, child support, maintenance, debts, retirement accounts, and other financial matters.
What if my spouse won't sign a separation agreement?
If an agreement cannot be reached voluntarily, unresolved issues may need to be decided through the litigation process.
Is a separation agreement legally binding?
Once approved by the court and incorporated into the appropriate orders, a separation agreement is legally enforceable.
Is a separation agreement the same as a divorce?
No. A separation agreement outlines the terms that resolve issues between spouses, while a divorce is the legal process that ends the marriage.
Can you change an agreement after mediation?
In many situations, yes. If both parties agree or if the law allows modification under certain circumstances, the agreement may be updated.
Can you back out of a mediation agreement?
Before a final agreement is signed and approved, circumstances may allow further negotiation. Once incorporated into a court order, changing the agreement is more difficult.
Can a judge overrule a mediation agreement?
Judges often approve agreements reached through mediation, but they may decline to approve provisions that are unlawful, unconscionable, or not in a child’s best interests.
